Developer API Terms of Service

These Developer API Terms of Service (the "Terms") are a binding agreement between you ("you," "Developer," or "Licensee") and Tarpon Web LLC, doing business as Triviuhh ("Triviuhh," "we," "us," or "our"). They govern your access to and use of the Triviuhh Question Bank API and related developer tools, dashboards, and documentation (together, the "API"). The API is a separate product from the consumer Triviuhh game, which is governed by its own terms.
By clicking to accept these Terms, creating a developer account, generating an API key, or otherwise accessing the API, you agree to these Terms. If you are agreeing on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity. If you do not agree, do not use the API. We record the version of the Terms you accept and the time you accept it on your developer account.
1. Definitions
"Question Bank"means our curated, structured, and continually updated database of trivia questions, including the selection, coordination, arrangement, categorization, tagging, difficulty rating, and other organization of that database (the "Compilation").
"API Response" means the data we return to you through the API in response to a request — typically a question, its correct answer, distractor answers, a short explanation, and associated metadata (category, difficulty, identifiers, and the like).
"Your Application" means the app, game, website, quiz, or other end-user product that you own or control and into which you incorporate API Responses.
"API Key" means the secret credential we issue that authenticates requests made under your account.
2. What you are licensing
The API Responses are generated and fact-checked using artificial intelligence, including Anthropic's Claude models. The value we offer is not any single question — it is the curated, structured, and quality-controlled Compilation as a whole, kept current and served reliably through the API.
We license the Compilation and the database, not a copyright in any individual question. Facts are not protectable by copyright, and the copyright status of AI-generated text is uncertain. Nothing in these Terms is a representation that any individual API Response is protected by copyright or owned exclusively by us. What we grant you is a license to use the API Responses as described below, drawn from our investment in building, organizing, and maintaining the Question Bank.
3. License grant
Subject to your compliance with these Terms (including payment of fees), we grant you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license, during the term, to:
- call the API using your API Key within your applicable plan limits; and
- reproduce, display, and incorporate API Responses into Your Application, and distribute those API Responses to end users of Your Application solely as an integrated part of Your Application's functionality.
This license is for use of the API Responses inside Your Application — not for redistribution of the Question Bank itself. We may update, add to, change, or remove content in the Question Bank at any time.
4. No exclusivity
Your license is non-exclusive. The API Responses are not unique to you. We may, and do, license identical or similar questions, answers, and explanations to other developers and customers, and the same or substantially similar content may be generated for, served to, or independently created by others. API Responses may also overlap with publicly known facts and with third-party trivia content. You receive no claim of exclusivity, originality, or uniqueness in any API Response.
5. Restrictions
You will not, and will not permit anyone else to:
- resell, sublicense, rent, lease, syndicate, or redistribute the raw Question Bank, the Compilation, or API Responses as a standalone dataset, feed, question bank, or API, whether for a fee or for free, or in any way that lets a third party obtain the content other than as an integrated part of Your Application;
- scrape, crawl, bulk-export, systematically download, or enumerate the Question Bank, or attempt to reconstruct or copy a material portion of it, by any means other than ordinary metered API calls within your plan limits;
- use the API Responses (or any data derived from them) to build, train, fine-tune, or improve a competing trivia or question-bank product, a competing content API, or any machine-learning model or dataset intended to substitute for or compete with the API or the Question Bank;
- cache or store API Responses beyond what is reasonably necessary to operate Your Application, or retain them after this agreement ends except as Section 11 allows;
- remove, obscure, or alter any attribution, identifiers, or notices we include, or misrepresent the source, accuracy, or authority of the content;
- reverse engineer, interfere with, probe, or test the vulnerability of the API, or circumvent rate limits, quotas, authentication, or other technical controls; or
- use the API in violation of any applicable law or any third party's rights.
AI provider restriction.The API Responses are produced with Anthropic's services. Under Anthropic's Commercial Terms of Service, a customer may not use those services or their outputs to build a competing product or service, including to train competing AI models. That restriction flows through to you: you may not use API Responses as training, fine-tuning, or evaluation data for any AI model, and may not otherwise use them to develop a service that competes with Anthropic or with us. 6. Acceptable use
You are responsible for Your Application and for how end users experience the API Responses. You will not use the API to create, support, or distribute anything unlawful, infringing, defamatory, harassing, or otherwise harmful, and you will comply with the laws and platform rules that apply to Your Application. We may set and publish additional acceptable-use or technical guidelines, and you will follow them.
7. API keys and security
Your API Key is a secret. Keep it confidential, do not embed it in client-side code or public repositories, and do not share it. You are responsible for all activity that occurs under your API Keys, whether or not you authorized it, and for all fees that activity generates. Notify us promptly at [email protected] if you suspect a key has been exposed or misused. We may rotate, suspend, or revoke keys at any time to protect the service, to enforce these Terms, or in response to suspected compromise.
8. Rate limits and quotas
Each plan includes a monthly allotment of questions and a per-key request rate limit. The free tier is a hard cap: when you reach the included monthly quota, further requests are rejected until the next monthly period or until you upgrade. Paid plans (Starter, Pro, and Scale) include a monthly quota and allow usage above it, billed as metered overage at the rate for your plan. Current plan quotas, rate limits, base prices, and overage rates are shown during sign-up and on your billing dashboard, and may change as described in Section 15. We may apply reasonable technical rate limiting to protect the service.
9. Fees, billing, and taxes
Paid plans carry a recurring monthly base fee plus metered overage for usage above your included quota. We use Stripe as our payment processor; by subscribing you authorize us and Stripe to charge your payment method for the base fee, accrued overage, and any applicable taxes. Usage is metered on our side and reported to Stripe for billing.
Fees are stated exclusive of taxes. You are responsible for all sales, use, value-added, and similar taxes, excluding taxes on our net income. Except where required by law or as expressly stated, fees are non-refundable, and partial periods, unused quota, and prepaid amounts are not refundable or creditable. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you remain responsible for fees and overage accrued through that date. If a charge fails or an amount is past due, we may suspend or revoke API access until payment is resolved.
10. Suspension and termination
You may stop using the API and close your account at any time. We may suspend or terminate your access, in whole or in part, if you breach these Terms, fail to pay, use the API in a way that risks harm to the service or others, or as required by law — with notice where practicable, and immediately where the circumstances warrant. We may also discontinue the API or any plan on reasonable notice.
11. Effect of termination
On termination or expiration, your license and your right to call the API end immediately, and we may disable your API Keys. You must stop making new requests and, within thirty (30) days, delete API Responses in your possession except for copies already embedded in released versions of Your Application and copies you must retain by law. Sections that by their nature should survive — including Sections 4, 5, 9, 11, 12, 13, 14, 15, 17, and 18 — survive termination.
12. Intellectual property
As between you and us, we retain all right, title, and interest in and to the API, the Question Bank, the Compilation, and our trademarks, software, and documentation, including all database rights and all rights in the selection, structure, and arrangement of the content. No rights are granted except the limited license in Section 3. You retain all rights in Your Application and in any content you independently create; nothing here gives us ownership of Your Application. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
13. AI-generated content; no accuracy warranty
The API Responses are generated and fact-checked using AI and may contain errors, inaccuracies, ambiguous or outdated information, or questions that are unsuitable for your audience. You are responsible for reviewing and deciding whether any API Response is appropriate for Your Application, and for any human review, filtering, or moderation your use case requires. We do not warrant that any answer is correct.
14. Disclaimer of warranties
THE API AND ALL API RESPONSES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE API WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THESE TERMS OR THE API, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE API WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID US FOR THE API IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITS APPLY ACROSS ALL CLAIMS IN THE AGGREGATE AND REGARDLESS OF THE THEORY OF LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You will defend, indemnify, and hold harmless Triviuhh and its owners, officers, and personnel from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to Your Application, your use of the API or API Responses, your breach of these Terms, or your violation of any law or third-party right.
17. Privacy and data handling
To operate the API we collect and process limited account and usage data — including your name, account email, contact email, organization name, API Key metadata, and request and usage metering used to enforce quotas and calculate billing. Payments are handled by Stripe, our payment processor, which collects and processes your billing details under its own terms and privacy policy; we do not store full card numbers. For details on what we collect, how we use it, and your choices, see the Developer Privacy Notice. You are the controller of any end-user data in Your Application; these Terms do not make us a processor of your end users' personal data.
18. Changes to these Terms
We may update these Terms from time to time. Each version carries a version identifier and an effective date. For material changes, we will give notice (for example, by email to your account address or a notice in the developer dashboard) and may require you to re-accept the updated Terms before you continue using the API; your acceptance and its timestamp are recorded on your account. Non-material changes are effective when posted. If you do not agree to an update, your remedy is to stop using the API and cancel.
19. Governing law and venue
These Terms are governed by the laws of the State of Florida, Florida, without regard to its conflict-of-laws rules, and the United Nations Convention on Contracts for the International Sale of Goods does not apply. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Pasco County, Pasco County, Florida for any dispute not subject to another agreed process.
20. Miscellaneous
These Terms (with any plan details and policies referenced here) are the entire agreement between you and us regarding the API and supersede prior agreements on that subject. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Nothing here creates a partnership, agency, or employment relationship.
